The Complexities Of Complex Civil Litigation Broken Down And Explained

Posted on November 30, 2013December 1, 2013 by Megan Landry

Everybody who lives has specific rights given to them by what ever creator they find faith with. In the human world society has devised laws to help protect everyone from harming each other or themselves. Criminal law covers basic ideas of right and wrong. Civil law though, covers every thing criminal law fails to address. While it is confusing, complex civil litigation after is is broken down can be understood by almost everyone.

Typically civil law works to resolve most noncriminal conflicts like disagreements on wording in contracts, divorce or child custody, property ownership issues and damage to personal or real property. Civil attorneys are the people that handle various lawsuits which can involve a business, individual and the government. They also act to protect or advise the different people they are representing in legal proceedings.

Some cases are simple and can be completed easily without too many issues. Cases that deal with lost wages, property damage or disagreements about simple contracts. With these there are generally only a few parties involved regarding a single claim. The end goal when suing for damages are typically simple to determine and easy for the courts to implement.

Complex litigation is typically a specialized docket of cases involving different civil suits. Typically when these cases get brought to the court, they are presided over by a single judge from the start to the end of the trial. To qualify for this a case is required to involve several parties, larger amounts of capital, long trial periods with many complex legal issues.

Most cases can be broken down into 7 distinct stages. Investigation, pleadings and discovery are the stages before any trial action happens. Pretrial, trial and settlement are the bulk of the trial proceedings. The appeal stage happens after the trial and is available to either party if they disagree with the decision of the court.

Not all suits follow every stage of litigation. Some get settled before going to trial and avoid costly expenses. Some are not appealed after they go to trial. Ultimately all cases are different even though they often follow similar courses through the court. The feel of most cases often dependent on how the lawyer thinks feels it will go in court and if a jury or a judge decide the verdict.

The average lifespan of many cases will often range from a few months to many years. Typically complex cases could take years to go from investigation to trial or settlement stage. The discovery stages are generally the longest and labor intensive stage of most cases. It is generally the most vital as well, during this part all the case information is found which supports each sides claim.

Even though television portrays most trial attorneys as spending much of their time inside a courtroom, this is often not the complete truth. When attorneys are working on complex civil litigation suits much of their effort is spent pursuing discovery. Even though many news reports show cases that often drag out for several years this is quite rare, the average suit typically lasts only 4-6 months.
